29 CFR 1910.134(d)(1)(ii): The employer did not select a NIOSH-certified respirator: a) Emergency and Radiology Departments, 111 Central Ave, Newark, NJ The employer provided and required employees, including but not limited to, registered nurses, patient care technicians, and radiology technicians, to use respirators labeled as KN95s while providing care for patients including those under investigation and/or confirmed as COVID-19 positive. The KN95 respirators did not contain certification markings indicating they were approved under a standard similar to NIOSH-certified N95 respirators. Violation occurred on or about 4/1/2020 and thereafter.
