OSH ACT of 1970 Section (5)(a)(1): The employer operates a business to repossess vehicles from purchase orders from the bank. In order to perform this task, employees operate the tow trucks. Each person works individually towing vehicles as assigned by the dispatcher. The employer did not ensure that the employees follow the manufacturer's specific requirements such as tow truck operations as specified by the equipment operations manual or other specific instructions that include safe vehicle towing, loading, off-loading, ground condition and sloping, etc. a) Job site, 3000 Monongahela Blvd, McKeesport, PA 15132: on or about February 18, 2020, The employer has not followed the manufacturers weight regulations for persons who operate the tow trucks in accordance to the Jerr-Dan MPL-NG self-loading wrecker manual. Page 3 of the manual states: total weight of the towing vehicle and the towed vehicle load must not exceed the GVWR (Gross Vehicle Weight Rating) of the towing vehicle.
