29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: (a) On or about July 15, 2019, the employer did not ensure that an effective inspection of the excavation and the adjacent areas was conducted by a competent person as needed throughout the shift, in that a protective system was not used while an employee conducted work in a trench that was greater than 5 feet deep, resulting in a collapse burying the employee.
