29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. 72 Grove St. Winchester, MA On or about July 2, 2019, the employer failed to instruct each worker in the recognition and avoidance of unsafe conditions exposed from being struck in the head by tools and construction materials, exposed to projectiles while operating pneumatic nail guns, and the appropriate use and installation of personal fall arrest systems. Instance A: Workers installing roofing material using pneumatic nail guns without eye and face protection. Instance B: Three workers working on the ground under roof stripping and shingle installation without head protection. Instance C: Workers were not instructed on the proper installation of UpGear D-ring anchors, the use of knots for personal fall arrest system vertical lifeline components, and when personal fall arrest systems must be used when exposed to fall greater than six feet.
