29 CFR 1915.12(a)(1)(ii): The employer did not ensure that spaces and adjacent spaces that contain or have contained combustible or flammable liquids or gases were visually inspected and tested by a competent person to determine the atmosphere's oxygen content prior to initial entry into the space by an employee. (a) Boat Barn - Fishing Vessel (FV) Progress - On or about February 1st, 2019 and at times prior thereto, employees were potentially exposed to oxygen deficient or enriched atmospheres while accessing confined and enclosed spaces including, but not limited to: Fuel Oil Tanks #1 port/starboard, #2 port/starboard, #3 port/starboard, #4 port/starboard and Fish Holds #1-4 without a gas free competent person inspecting and testing for oxygen content. Employees were stick welding and cutting with oxygen and acetylene torches which can create an oxygen enriched or deficient atmosphere.
