29 CFR 1910.22(d)(1): The employer did not ensure that walking-working surfaces were inspected, regularly and as necessary, and maintained in a safe condition: (a) On or about April 15, 2019, the employer did not inspect working surfaces, such as the dock plates at doors 41, 32, 23 and 13, to ensure that deficiencies in the surfaces, such as the broken concrete of the dock at the edge of the steel plate or the 2.5 inch gaps between the dock plates and dock plate bumpers at each side of the doorway, would not cause injuries to employees who were crossing these dock plates with fork lifts while loading and unloading freight from trailers as part of their daily job duties. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
