29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) MRG Construction LLC, at 5959 N Dunkirk Street, Denver, CO: On and preceding 10/12/18, the employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. Employees were installing exterior sheathing on a two-story multi-family residential structure. An employee secured the sheathing by leaning outward through a wall opening on the second floor. The employee fell approximately 11 feet to the ground when the guardrail failed. The employer did not ensure that the employee was following safe work practices, in that employees were leaning outward through wall openings, were not maintaining the proper tension in the personal fall arrest system, and that the guardrails as well as personal fall arrest system were properly installed. This condition exposed employees to approximate 11 foot fall hazards.
