OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck-by or crushing hazards when operating a forklift without the use of a restraint device: (a) On or about August 30, 2018 and at times prior thereto; the employer did not provide a seatbelt for the operator(s) of the Hyster H110XL, S/N G005D14489W.
