29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section: a) Rolling Plains Construction, Inc. at 6700 N Gaylord Rockies Blvd., Aurora, CO 80019: On or before April 25, 2018, the employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section. In the process of fireproofing structural steel and other parts of this facility, employees emptied bags of Grace Monokote Z-106 HY into an open top vertical mixer. This product contained 50% to 100% Portland cement, and 1% to 2% Quartz. The employer provided N-95 dust masks for use on a voluntary basis, and provided fans for supplemental ventilation. The employer did not adequately assess employee exposure to silica. This condition exposed employees to respiratory hazards.
