29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. On March 20, 2018, located at a commercial structure, an employee was operating a JLG Gradall G6-42A, Serial #160034246, Rough Terrain Forklift that had an attachment used for free rigging a load of bricks below the tines. The employer did not obtain written manufacturer's prior approval, or written approval from a Qualified Registered Professional Engineer, for modification of the powered industrial truck for use of the attachment.
