29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment: The employer is failing to protect employees from chemical hazards associated with using a toxic chemical through spray application in the work place without having conducted a formal hazard assessment as means of identifying what types of PPE will be necessary. The most recent occurrence of this was documented during the inspection on January 9, 2018 of the facility located at 103 West 3rd St. Imperial, NE where the employer has an ineffectively protected employee exposed to chemical burns while using a highly toxic car wash cleaning product called Nu-Wall.
