29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) Funeral Home - An embalmer, exposed to formaldehyde during embalming operations, at an 8 hour time-weighted average level of 0.46 ppm, was not provided a medical evaluation prior to being required to use the 3M 6300 half-face model tight-fitting respirator provided to protect against exposure to Triton 28, a formaldehyde product used in embalming operations on or about January 10, 2018. (b) Funeral Home - An embalmer, exposed to formaldehyde during embalming operations at an 8 hour time-weighted average level of 1.7 ppm, was not provided a medical evaluation prior to being required to use the 3M 6900 full-face model tight-fitting respirator provided to protect against exposure to Triton 28, a formaldehyde product used in embalming operations, on or about January 10, 2018. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
