29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. On or about October 26, 2017, employees were required to operate the REALLIFT Model # CPQD25N-RW26-Y forklift after it was found to have defective brakes. On September 10, 2017, the forklift struck a customers vehicle in the parking lot after the brakes failed. Employees continued to operate the forklift daily for the seven weeks following the incident without the brakes being repaired, thereby exposing them to struck-by hazards.
