29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres or other hazardous conditions: (a) Jobsite, Brownfield and Gun Club Road, Uniontown, PA: On or about September 22, 2017 the competent person did not conduct daily inspections to ensure there was no situation that could result in a cave-in. A trench shield had been placed in the excavation and was not installed in accordance with specific guidelines. The shield was not installed against the side walls and the ends of the shield were open. A section of a side wall collapsed where an employee was standing causing the employee to fall approximately 13 feet into the unprotected area between the shield and sidewall. The employee suffered broken vertebrae.
