40.1-51.1(a) of the Code of Virginia: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: it failed to require compactor operators to make sure that the area to be compacted was free of workers, vehicles, and pedestrians before changing direction. On October 23, 1997, a compactor operator failed to make sure that the area to be compacted was free of workers before he changed direction. Shortly after changing direction, the compactor struck and killed an employee working in the compactor's path of travel. One feasible and acceptable abatement method to correct this hazard is to adhere to American National Standard Institute (ANSI) standard A10.17-1975, Safe Operating Practice for Asphalt Pavement Construction (3.3.3: Operators of bidirection, self-propelled compactors shall be sure that the area to be compacted is free from vehicles, workers, and pedestrians before changing direction).
