29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: a) Heavy Equipment Shop back storage room: A mezzanine storage area, used to store items, such as, but not limited to, Envirobags and hoses, did not have a fall protection system to prevent employees from falling nine feet to the ground below, on or about 8/11/17. b) Yard Fueling Station: A platform used to access the On Road fuel tank did not have a mid-rail, on or about 9/8/17. c) Yard Fueling Station: A platform used to access the Off Road fuel tank did not have a mid-rail, on or about 9/8/17. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
