Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about 03-28-96 at the Marriot construction site at 425 Bonham, San Antonio, the 91 "Schwing", number 120032, concrete pump truck's boom was closer than 17 feet (5 m) minimum distance to overhead power lines required by the truck's manufacturer and the ACPA. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow manufacturer's guidelines as specified in the operator's manual and safety decals.
