Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential hazards of oxygen deficient, toxic, or explosive atmospheres when entering confined spaces without observing adequate entry procedures: COMPANY: The company did not develop and implement a Confined Space Entry program or procedures for workers required to enter newly constructed sewer man hole(s) to complete the construction: Among others, one feasible and acceptable abatement method to correct the hazard would be to develop a written program along with establishing standard procedures for safe entry into sewer man holes as well as other confined spaces.
