Text For Citation: 01 Item/Group: 001A Hazard:

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about April 10, 2017, and prior, and during employment using a Live Bottom Trailer equipped with a point of entry operation guard, designed to reduce the exposer of accidental contact with the belt conveyor, to convey and deliver asphalt for construction projects in Texas, at least one employee used a hand tool to clean excess product from the Live Bottom Trailer's rear gate door, and the PTO-driven belt conveyor, while the PTO was energized and operational, and was exposed to the potential for serious injury. Feasible and acceptable abatement methods to correct this hazard include, but are not limited to, following the Trail King owner's manual for general operating information, including the Safety Warning to always disengage the PTO drive, shut down the engine and remove the switch key before performing any clearing or servicing of any kind.
