29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. a. In the paint booths, employees were not provided with a medical evaluation to determine the employee's ability to use a 3M 07193 half-face dual cartridge respirator. This violation was discovered on or about April 5, 2017. The R&B Auto Body Transport Refinishing, LLC was previously cited for a violation of this occupational safety and health standard 1910.134(e)(1), which was contained in OSHA inspection number 990738, citation number 1, item number 1-c and was affirmed as a final order on November 14, 2014, with respect to a workplace located at 4655 118th Avenue N, Clearwater, FL 33762.
