Section 5(a)(1) of the Occupational Safety and Health Act of 1970: %% The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Prior to the accident which occurred on or about October 23, 1995, the employer did not comply with General Note Specification S-1 project drawing which required that grout for filling reinforced and non-reinforced cells be placed in maximumof 4 ft. lifts, and that such cells be fully grouted; and the employer did not follow industry standards, practices and recommendations of the American Concrete Institute (ACI), the Manual of Concrete Practice (Part 51991), the National Concrete Masonry Association (NCMA-TEK), and other recommendations found in Masonry Design And Detailing for the safe construction of masonry walls. A feasible and useful means of abatement includes, but is not limited to the following actions: 1. Ensure that all supervisory personnel are properly trained in accordance with standards, work practices and recommendations found in the ACI,NCMA-TEK, and other relevant resource documents with respect to grouting and bracing. 2. Devise a program to ensure that project drawing specifications are followed. 3. Devise a means of communication between the employer and his supervisors and other employees to ensure that safety-related work practices are known, understood and implemented among them.
