Text For Citation: 01 Item/Group: 001A Hazard:
Section (5)(a)(1): The employer failed to furnish to each of his employees employment and a place of employment which was free from recognized hazards that were causing or are likely to cause death or serious physical harm, in that employees were exposed to struck-by hazards: (a) On or about February 22, 2017 for an employee who sustained fatal injuries after being struck by a truck while acting as a spotter at the project site located at 1910 26th Street West in Williston, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method to abate this hazard would be for the employer to follow the guidance set forth in the NIOSH publication: Workplace Solutions: Preventing Working Injuries and Deaths from Backing Construction Vehicles and Equipment at Roadway Construction Worksites. Specifically, NIOSH recommends that worksites be designed to minimize backing vehicles and equipment and for employers to facilitate daily communication between prime and subcontractors to discuss traffic flow. Additionally, policies requiring proper communication and coordination between spotters and drivers could minimize confusion between parties.
