Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and/or crushed-by hazards: (a) At the worksite - Two employees tasked to dismantle an excavator were exposed to struck-by and/or crushed-by hazards. One of the employees was injured when a 6.2 ton counterweight fell onto him while they were attempting to remove it from the excavator; on or about 02/15/17. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $ 1,000.00 AS PER 29 CFR 1903.19.
