29 CFR 1910.132(d)(1)(i): When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the hazards identified in the hazard assessment; (a) On September 22, 2016, the employer did not select and have employees use personal protective equipment to protect against chemical burns when cleaning the tank of white liquor, in that two employees who entered the tank received serious chemical burns to their legs when the white liquor leaked through the chemical tape that was sealing the boots and rain suits the employees were wearing. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
