OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards related to damaged forklift seatbelt assemblies: a) Loading dock - On or about February 3, 2016, a Nissan Model 30 forklift identified as #5, serial number 9N2054, featured a broken seatbelt assembly, preventing employees from being properly restrained during forklift operation. Among other feasible means of abatement, the employer must repair seat belt assemblies when they are discovered to be damaged or inoperable during daily inspections.
