Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling with an elevator car-sling and platform free falling from upper levels to the elevator pit and/or being struck by a free falling elevator car-sling and platform and/or its components. a)Job Site: 365 Fifth Ave., New York, NY - The employer failed to load test car- slings and platforms, before permitting workers to ride to assure that the wire rope could safely sustain the load. The failure to do so exposed workers to falls within the elevator of up to 177-feet to the elevator pit; on or about March 29, 1999. ABATEMENT: Among other methods, one feasible acceptable method to correct this hazard is: 1) Follow the recommended industry practice described in the ELEVATOR INDUSTRY FIELD EMPLOYEE'S SAFETY HANDBOOK (revision 3/99), Chapter 3, page 58 which details the daily safety tests that should be performed and documented. ABATEMENT VERIFICATION IS REQUIRED FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $ 1000.00, AS PER 29 CFR 1903.19..
