29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: The employer did not develop and implement a monitoring program, including a sampling strategy designed to identify employees for inclusion in the hearing conservation program, for employees exposed to occupational noise equaling or exceeding an 8-hour time-weighted average of 85 decibels. a) One employee was exposed to continuous noise levels at 111.1% of the permissible 8-hour TWA. The equivalent dBA level of 111.1% is approximately 90.7 dBA. Sampling was performed for 476 minutes during one shift. Zero exposure was assumed for the unsampled period of 4 minutes; b) One employee was exposed to continuous noise levels at 68.70% of the permissible 8-hour TWA. The equivalent dBA level of 68.70% is approximately 87.3 dBA. Sampling was performed for 430 minutes during one shift. Zero exposure was assumed for the unsampled period of 50 minutes; c) One employee was exposed to continuous noise levels at 202.6% of the permissible 8-hour TWA.
