Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of burns from contact with and/or being covered by hot ash in that employees were removing hot clinkers from a plugged hot ash hopper on the fifth floor of the boiler house. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: (1) Cool down the contents of the hopper by flushing with water prior to opening the hopper door. (2) Contain hot ash and clinkers through a chute to a holding area where it can be disposed of after cooling. (3) Develop written procedures for continuity and implementation of safety measures required to unplug the hopper including appropriate personal protective equipment. (4) Schedule frequent maintenance for rotary seals on the hopper to prevent air leakage. On or about 9-3-92.
