29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, rotating parts and flying chips: (a) Production: The employer failed to ensure that guards or methods of guarding on the Toshiba TUE-200 vertical boring and turning machines, including the Toshiba TUE-200 Serial # 440660, were adequate to prevent employees from entering the machine where point of operation, rotating parts, flying chips and a rotating table were present. On April 15, 2015, an employee was fatally injured when he was performing work inside the Toshiba TUE-200 Serial #440660 Vertical Boring and Turning Mill. The safety interlocks on the machine doors had been disabled. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete and must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase, or repair of the equipment, photographic or video evidence of abatement, or other written records.
