Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of crushing injuries in the event of forklift tipover: The alleged violations below have been grouped because they involve similar or related hazards that may increase the potential for injury resulting from an accident. a) Operator restraint systems (seat belts) provided on forklift trucks were not required to be used by forklift operators while traveling in the warehouse and parking lot area. An employee (forklift operator) who was not wearing a seat belt was fatally injured when his forklift over turned in the parking lot area on September 26,1991. One feasible and useful method to correct this hazard is to require and effectively enforce the use of operator restraint systems while operating forklift trucks.
