Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards and inhalation hazards resulting from exposure to toxic and flammable air contaminants and/or oxygen deficient atmospheres during work in confined spaces: The alleged violations below have been grouped because they involve similar or related hazards that may increase the potential for illness. a) Appropriate confined space entry procedures were not implemented for the protection of an employee who entered a tank for the purpose of abrasive blasting activities on April 25, 1991. One feasible and accepted abatement method is the utilization and enforcement of the Pennline Industries, Inc "confined space entry program" which was transmited to OSHA in written correspondence dated April 12, 1991. (It should be noted that confined space entry observed by OSHA on April 25, 1991 was performed without: (1) atmospheric testing of the tank, (2) a standby observer, (3) posting the tank with the completed entry permit (procedure), and (4) readily available emergency standby equipment.
