Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck due to uncontrolled movement of unit or falling from a height up to 39 feet: a)Site 65 East 55th Street:Employees using the Genie to install lights on tree were exposed to the hazard of uncontrolled movement of unit striking employee or employee falling from height of 39 feet due to not operating the Genie with all four outriggers in place and pads contacting ground as required by manufactures safe operating procedure manual, on or about 11/27/96. Abatement Note: Among other method, one feasible and accepted method to correct this hazard is to use the Genie as instructed by manufacture and required in ANSI A 92.3 1990 Section 8.8.ion
