Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to the employee in that: On or about 3/23/3 employees operating a freight elevator and/or working in the vicinity of a freight elevator were exposed to the hazard of falling into the open elevator shaft and/or being crushed or being struck by the elevator car. The bottom portion of the Pelle bi-parting vertical slide shaftway door was not provided on the third floor northside of elevator. Among other methods one feasible and acceptable abatement method to correct this hazard is to provide a complete vertical slide biparting vertical door of hoistway with manual locking device from inside of elevator shaft, operated only from the car.
