29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a) At the job site, on October 8, 2014, the employer did not ensure that an employee who was preforming preparation work in the excavation, that measured five feet in depth with a spoil pile at the edge of the excavation that measured three feet in height for a total depth of eight feet, wore a hard hat to safeguard against falling debris, exposing the employee to the hazards associated with bruises and lacerations to the head.
