Text For Citation: 01 Item/Group: 001 Hazard:
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling with and/or being struck by a shop-built lift basket used to lift personnel on the forks of forklifts. On or about October 8, 2014, and at times prior thereto, the employer provided a shop built personnel basket for use with multiple forklifts of different manufacturers without ensuring the design was compatible with each forklift configuration. Among other defects, the basket was not equipped with a secure means of attachment, was longer than the forks of the forklift, and was not equipped with a midrail.
