29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: 1065 South Street, Needham, Ma: Site, Asphalt Dump Truck and paving job: Employees are exposed to fall and burn hazards due to lack of proper personal protective equipment while in the raised dump body of an asphalt truck containing hot asphalt. 1. A worker standing on hot asphalt in the bed of the truck was burnt on his legs when a chute was opened and the asphalt shifted and he sank into the hot asphalt. The injured worker was wearing shorts. 2. The worker was in the raised dump body exposed to falling without fall protection.
