OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. At the time of the inspection, employees were exposed to possible serious injury due to tripping and/or fall hazards from a 15 inch by 17 inch floor opening on the working platform near the clean sand discharge chute that was not covered or guarded. Abatement: One method of abatement to correct this apparent hazard is to install a hinged floor opening cover or standard guardrail system when the chute opening is not in use. DISCLAIMER: a/ The employer is not limited to the abatement method(s) suggested by OSHA. b/ The employer is responsible for selecting and implementing an effective abatement method. IN THE ALTERNATIVE; 29CFR 1910.23(a)(3)(i): Hinged floor opening cover of standard strength and construction equipped with standard railings or permanently attached thereto so as to leave only one exposed side. When the opening is not in use, the cover shall be closed or the exposed side shall be guarded at both top and intermediate positions by removable standard railings. At the time of the inspection, employees were exposed to possible serious injury due to tripping and/or fall hazards from a 15 inch by 17 inch floor opening on the working platform near the clean sand discharge chute that was not covered or guarded. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.
