29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: a) New York Avenue Apartments, 233 North New York Avenue, Atlantic City, NJ 08401: On or about August 15, 2014 the employer did not evaluate the workplace to determine if the elevator shaft was a confined space. An employee died in an elevator shaft after being crushed by the elevator counterweight. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
