Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm to employees in that employees were exposed to entrapment and/or struck-by hazards while employees were operating motorized equipment: At the job site of 5056 N. Lycee, Bel Aire, Kansas, LMT Construction employees operating equipment were exposed to entrapment and/or struck-by hazards in that seatbelts were not in use: a) White skid steer with forks (Model Bobcat T320 Track) b) Yellow all-terrain forklift (Model TH83 Serial 7BJ56996) Feasible and acceptable methods to abate this hazard includes but is not limited to: Ensure compliance with American Society of Mechanical Engineers (ASME) B56.1-1993, paragraph 5.3.19 which states "An active operator protection device or system, when provided, shall be used."
