OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards due to unsecured vehicles: a. On or about June 23, 2014, at the above located workplace, employee(s) performing concrete unloading operations on the "top of the hill" were exposed to struck-by hazards created by unsecured (unchocked) vehicles parked on an incline. An employee was fatality injured when a dump truck (Mack Granite Series, Truck #333) that was stopped on an incline, not properly secured, moved and struck the employee.
