OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to inhalation and exposures of Ammonia. On or about 6/10/14, at the Gainesville facility, employees were exposed to ammonia hazards as the employer did not ensure the room was enclosed (13.1.1.3), was equipped with tight fitting doors that had panic type hardware rather than a rollup door (13.1.10.2) and had an exit discharging directly outside from the engine room (13.1.10.3). This hazard is recognized in safety documents: ANSI/IIAR 2-2008 Equipment, Design and Installation of Closed Circuit Ammonia Mechanical Refrigeration Systems, 13.1 Machinery Room Design, Addendum A. 29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed. On or about 6/10/14, at the Gainesville facility, the employer did not ensure egress routes on the roof were kept free and unobstructed in that refrigeration employees had to climb over and under ammonia refrigeration piping and traverse different elevations (14 in. apart) in the egress path in the event of an emergency. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
