Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while riding on the golf bag storage area of a moving E-Z-GO Golf Cart: The employer is failing to protect workers from the hazard of falling. This violation most recently occurred on or about May 6, 2014, when employees using an E-Z-GO Golf Cart, for the purpose of traveling across the property, were exposed to the hazard of falling from the moving cart to the ground below, in that employees were not properly seated and using safety restraints while riding in the Golf Cart. Feasible and acceptable means to abate this hazard includes, but is not limited to: Develop a written program and provide training to employees on the safe use and operation of motorized equipment in accordance the manufactures E-Z-GO Technicians Repair and Service Manual to include vehicle placarding instructions. Ensure that all persons utilizing E-Z-GO vehicles for personnel transportation are provided a securely fastened seating arrangement with body restraints in accordance with paragraphs 9.5.3 and 9.5.4 of the manufactures E-Z-GO Technicians Repair and Service Manual and vehicle placarding instructions.
