OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to the hazard of being crushed by the Toyota powered industrial forklift trucks in the event of a tip-over accident: a) On February 24, 2014, and at times prior thereto, throughout the work site; Seat belts were not being used by the operators of the Toyota powered industrial trucks that were being used to move items such as, but not limited to, pallets, mail, trash etc. The employees were exposed to the hazards of being crushed by potential roll-over action of the fork trucks.
