Text For Citation: 01 Item/Group: 001 Hazard:

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees when an employee was exposed to caught-between and struck-by hazards: (a) On or about January 9, 2014 when a trailer attached to a Kenworth Tractor became mired in mud, a CAT 336E track excavator was positioned 15.5 feet from the front of the tractor. An employee was assigned to attach a tow strap between the tractor and bucket of the CAT 336E while the operator was in the cab of the excavator with the hydraulic system energized and fully responsive to controls. The joystick for the crowd arm was actuated to extend the crowd arm which caused the bucket to fatally strike the worker. Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).
