OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees with exposures to TNT above the OSHA PEL and ACGIH TWA, were not provided adequate medical surveillance to assess and identify adverse health effects: De-milling Process, on November 6, 2013, and at times prior thereto, employees who were exposed to TNT were not provided all components of medical surveillance including but not limited to: a) Three employees had Hgb drop 1.9 mmo/dl or more from baseline and employees were not evaluated for removal from exposure or additional testing. b) Between 2009 and 2013 eight employees hematocrit dropped more than 2.9% from baseline and were not evaluated for removal from exposure or additional testing. c) Employees were not evaluated for skin discoloration, cataracts, contact dermatitis, urine discoloration, elevated GGT and Hp (haptoglobin).
