OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation and crushing hazards when working in an elevated platform on the forks of a material handling powered industrial truck that did not have protection against the moving parts of the mast. Maintenance employee(s) stood on a platform elevated on the forks of a material handling powered industrial truck in order to access and repair equipment and electrical components at heights up to approx. 12-15 feet. The platform was deficient in that it did not have adequate guarding to protect employees from getting caught in the moving parts of the mast. There is no abatement documentation or certification required for this item.
