29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a) Throughout the paper mill and yard around the paper mill, on or about October 21, 2013 and at times prior to, employees were exposed to a hazard of being struck by mobile equipment used around the paper mill. 1) The employer did not remove from service a Hyster forklift #202 which has a non-functioning right head light and right tail light for use during night operations. 2) The employer did not remove from service a Hyster forklift #50 which had a non-functioning right tail light. 3) The employer did not remove from service a Clark forklift #25 which had a non-functional left head light. ABATEMENT CERTIFICATION IS REQUIRED
