OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a struck-by and caught-in-between hazards while performing maintenance. a) On or about October 1, 2013, and at times prior thereto, an employee bypassed the safety start switch on a Stieger CU 360 while standing on the ground level which caused the tractor to lurch forward and run over him. b) On or about October 2, 2013, and at times prior therto, an employee crawled into the engine compartment of a Case International 9280 to change the hydraulic hoses and did not ensure equipment was properly disengaged from inadvertent movement.
