OSH ACT of 1970 Section (5)(a)(1): Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees, in that, employees were exposed to: Crushing hazard from operating a powered industrial truck which was not equipped a seat belt in the forklift operator's seat. (a) Rear of Building, Outside - On or about September 4, 2013 employees were exposed to crushing hazard from tip-over while operating a forklift transporting loads. Clarke forklift (Model C500Y60, serial Number Y685-467-2153) was not equipped with a seat belt in the operator's seat.
