Text For Citation: 01 Item/Group: 001 Hazard:
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard. Worksite: 899 Freehome Road, Cumming, GA, on or about 08/15/2013, employees, not involved in the felling operation, were exposed to being struck by falling tree components and were not removed from the fell pattern of the tree before the cut was made. Among other methods one feasible and acceptable method to correct this hazard is; 1. Direct and train all employees involved in the removal to stand clear beyond the length of the fell pattern of the tree when cutting begins, in accordance with ANSI Z133.1-2006, Section 8.2.1 and Section 8.5 and Section 8.7. The cutter must confirm, whether through visual contact or through audible response, that all employees are out of the fell pattern before starting the cut. 29 CFR 1903.19, within ten (10) days, the employer must submit documentation describing the actions it is taking to establish, communicate and implement abatement for the hazard.
